Beta terms

BOBcloud Monitor is in beta. These terms apply to anyone using it during the beta, alongside our privacy policy. They are between you and SCDC Limited, trading as BOBcloud.

What Monitor does

Monitor installs a probe on each Windows or Linux machine you choose. The probe reads what the machine reports about itself and sends those readings to our server, which grades them and shows them in the portal.

What the probe does not do

It never changes anything on the machine. It reads settings and states. It does not edit files, alter configuration, install or remove software, apply updates, change registry keys or policies, or run anything you have not installed.
It has no remote control and no remediation. There is no way for us, or for you through Monitor, to make a change to a machine you are monitoring.
It never accepts instructions from our server beyond asking whether a newer version of the probe exists. It only updates itself to a release whose signature it can verify, and only when you have turned automatic updates on.
It does not read your files or your clients' data. It reads the state of the controls listed in the documentation, and an inventory of hardware and installed software.

The probe runs as SYSTEM on Windows and as root on Linux, because the settings it reads need that. It makes outbound HTTPS connections to one address, collector-uk-1.bobcloud.net, and accepts no inbound connections.

Monitor reports, you decide

Monitor reports what each machine says about itself. That is an attestation, not proof.

Acting on a reading, and judging whether a machine is fit for purpose, is yours and your client's decision, not ours.

Monitor is not a certification, and using it does not certify anything. It is not endorsed, approved or accredited by any certification body. It monitors some of the technical controls a Cyber Essentials assessment looks at, on Windows and Linux endpoints only. It does not cover multi-factor authentication, cloud services, or network devices such as routers, switches and firewalls.

It is beta

Monitor is free during the beta.
It changes often, sometimes weekly, and it may break.
There is no service level and no guarantee that it is available, that a reading is correct, or that an alert arrives.
Features may change or be withdrawn.
Support is by email on a best-efforts basis.

Your responsibilities

You confirm you are entitled to install the probe on the machines you enrol, and to share their readings with us.
You are responsible for telling your clients that you use Monitor, if your agreement with them requires it.
You keep your sign-in details to yourself, and you tell us promptly if you think an account has been reached by someone who should not have it.
You do not use Monitor to monitor machines you do not look after.

Your data

We hold your account details, the readings from your machines, your audit log and the evidence packs you generate.
Our server is in Germany. SCDC Limited is registered in England and the service is run from the UK.
We use your details to run Monitor and to contact you about it. We do not sell them or pass them to anyone else.
When an account is closed, it is suspended at once and deleted 30 days later. What is kept after that, and for how long, is set out in Closing an account.

Liability

Monitor is provided as is, with no warranty of any kind.

To the extent the law allows, we are not liable for any loss arising from your use of Monitor, or from relying on anything it reports or fails to report, including a reading that turns out to be wrong, an alert that does not arrive, or a machine that stops reporting without being noticed. This includes lost profits, lost business, lost data, and any indirect or consequential loss.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

Monitor is a monitoring tool, not a security control. It does not protect a machine, and it is not a substitute for your own checks.

Ending it

You can stop at any time: uninstall the probes and email support@bobcloud.net to close your account. We can end a beta account at any time, and we will tell you if we do.

Changes to these terms

We may change these terms during the beta. The current version is always on this page, with the date it was last updated. If we make a change that matters, we will email account owners.

Governing law

These terms are governed by English law, and the courts of England and Wales have exclusive jurisdiction.
