1. Who We Are
These terms govern your use of the BOBcloud cloud backup platform, operated by SCDC Ltd, registered in England and Wales. Our registered address is The Old Royal Mail Sorting Office, Stokes Road, Corsham, Wiltshire, SN13 9AA.
By creating a reseller account or using our services, you agree to these terms. If you are accepting on behalf of a company, you confirm you have the authority to bind that company.
Our services are available to IT support companies, managed service providers, and IT resellers only. We do not provide reseller accounts to end users directly.
2. The Service
BOBcloud provides a white-label cloud backup platform. As a reseller, you access our platform to provide backup services to your own clients. You are responsible for managing your client accounts, configuring backup sets, and ensuring your clients use the platform appropriately.
We license our core backup software from Ahsay Systems Corporation. Your use of the platform is also subject to Ahsay's end-user licence terms.
3. Free Trial
Resellers can grant 30-day free trials with 1TB of cloud storage to their clients. No payment details are required to start a trial.
4. Accounts and Reseller Responsibilities
You are responsible for:
- Keeping your account credentials secure and not sharing them with unauthorised individuals
- All activity that takes place under your reseller account, including activity by your clients
- Ensuring your clients understand what data they are backing up and that they have appropriate rights to do so
- Performing regular test restores to verify that backups are completing successfully and that data can be recovered
- Notifying us promptly if you become aware of any unauthorised use of your account
5. Billing and Payment
We invoice in arrears on the 1st of each month for the previous month's usage. Invoices are based on storage consumed and licences active during that period.
UK customers are invoiced by Direct Debit, collected 10 days after the invoice date. International customers may pay by PayPal or credit card.
If a payment fails and is not resolved within 14 days of notification, we reserve the right to suspend your account. Data will be retained for 30 days following suspension before being permanently deleted.
6. Termination
You may terminate your account at any time after the first billing cycle by deleting the account from your reseller portal. There are no fixed-term contracts and no early termination fees.
We may terminate or suspend your account immediately if you materially breach these terms, engage in behaviour that puts the platform or other customers at risk, or fail to make payment after reasonable notice.
7. Storage and Infrastructure
Backup data is stored on Microsoft Azure and Wasabi cloud infrastructure. Both providers are ISO 27001 and SOC 2 Type II certified. Microsoft Azure provides 11 nines (99.999999999%) data durability on stored objects.
We target platform availability of 99.9% on a monthly basis, excluding scheduled maintenance windows which we will communicate in advance. Where infrastructure availability falls below this level due to circumstances within our control, we will work promptly to restore service.
We are not responsible for outages or data loss caused by third-party infrastructure providers, force majeure events, or circumstances beyond our reasonable control. Our upstream providers' own terms and SLAs apply to the underlying infrastructure.
8. Data Encryption and Security
All backup data is encrypted client-side using AES-256 encryption before it leaves the device. The encryption key is set by you or your client at the time of creating a backup set.
We do not hold, store, or have any means of accessing your encryption passwords. If an encryption password is lost, the backup data encrypted with that password cannot be recovered. You are solely responsible for maintaining a secure record of all encryption passwords.
Because data is encrypted before it reaches our systems, we have no ability to inspect, read, or process the content of backed-up data.
9. White Labelling
White-label branding of the reseller portal, client-facing emails, and backup client software with your own logos and brand name is available free of charge.
You may not represent yourself as BOBcloud or SCDC Ltd to your clients or imply that you are the developer of the underlying backup software.
10. Switching Credit
If you are moving to BOBcloud from another backup provider, we offer a switching credit of up to £250, calculated against your existing provider's current invoice. Contact us to claim this credit. The credit is applied as a deduction from your first invoice and is available to new reseller accounts only.
11. Acceptable Use
You must not use our platform to back up data you do not have the right to store, or use it for any unlawful purpose. You must not attempt to circumvent any technical limits, access controls, or security measures on the platform.
We operate a zero-tolerance policy towards abusive, threatening, or inappropriate behaviour directed at our staff.
12. Limitation of Liability
Our maximum aggregate liability to you under these terms is limited to the total fees paid by you to us in the three months preceding the event giving rise to the claim.
We are not liable for any indirect or consequential loss, loss of data, loss of profits, loss of business, or loss of goodwill, even if we have been advised of the possibility of such loss.
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
13. Your Personal Data
When you create an account with us, we collect your name, company name, email address, and billing information. We use this information to operate your account, send invoices, and provide support.
We do not sell or share your personal data with third parties except where necessary to operate the service — for example, our payment processor and cloud storage providers.
You may request deletion of your account data at any time by contacting us. For full details of how we handle personal data, see our Privacy Policy.
The backup data your clients store through our platform is encrypted before it reaches us. We cannot access, read, or process its contents and therefore have no obligations as a data processor in relation to that data under UK GDPR.
14. Changes to These Terms
We may update these terms from time to time. We will notify you by email at least 30 days before material changes take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.
15. Governing Law
These terms are governed by English law. Any disputes arising under these terms are subject to the non-exclusive jurisdiction of the English courts.
